Overview
A case where a Strata Company wanted a lot owner to remove a large tree (lemon-scented gum) from within their part lot garden area.
This was primarily because the roots were causing damage to the CP driveway. There were also issues with shading, branches falling, leaf litter and pavers lifting. The Tribunal ruled in favour of the Strata Company and made an order that the tree must be removed at the lot owners expense.
