Summary

In this case, delivered on 03 Aug 2021, the applicants challenged the validity of the by-law banning pets, except with permission from all owners (which was denied). The applicant wanted to keep their pet Chihuahua in the unit, whilst in residence at their holiday home in Broome. The scheme was intended as holiday accommodation and not "residential" and due to this, and other factors, the by-law was considered reasonable. The challenge was unsuccessful.
